Can I set up a payment plan if I have fallen behind?

**Yes, and the Association has done this.** If you cannot pay your assessment in full, **contact the office to make arrangements in advance**. That last part matters — an arrangement made before the due date is a very different conversation from one made after a delinquency has been running for months.

**These are informal and case by case.** There is no written hardship or installment policy in the governing documents. Each arrangement is handled on its own facts, so nothing here should be read as an entitlement to particular terms.

**Be clear about what a payment plan does not do.** It does **not** restore your good standing.

- **You are not in good standing until your balance reaches $0.**
- **Amenity access stays restricted** for as long as a balance remains.

That is the part members most often misunderstand. Agreeing to a plan and keeping to it is the right thing to do, but it does not put you back on the amenity list part-way through. The covenants let the Association suspend enjoyment rights for **any period during which any assessment remains unpaid** — the test is the unpaid balance, not whether you are making an effort.

**Interest and penalties.** The covenants provide for a penalty fee of up to $25 if an assessment is not paid within 30 days of the delinquency date, and interest at 12% per annum on the delinquent balance and penalty from that date. Ask the office how these are treated under any arrangement you make, rather than assuming they stop.

**Why to raise it early.** Unpaid assessments become a continuing lien on the lot, and the Association may sue personally or foreclose the lien, with costs and attorney fees added. A conversation with the office is a much better path than any of that.
