Can I appeal a suspension of my membership rights?

Yes. How it works depends on why you were suspended.

**If it is about unpaid assessments.** The By-Laws give you the right to appeal to the Board. To succeed you have to establish, by competent evidence, good cause for lifting the suspension. What counts as good cause is decided in the sole discretion of the Board. In other words, the appeal is real, but the bar is set by the Board and its decision is the one that governs.

You can also simply pay the balance, in which case your rights come back automatically and no appeal is needed.

**If it is about conduct.** The Rules & Regulations deal with this separately. Where privileges are suspended for obscene or abusive language or actions toward another member, a guest, or an Association employee, the suspended person has the right to appeal at the **next scheduled Board of Directors meeting**.

**How long a conduct suspension lasts.** The covenants set a limit here that does not apply to assessments. For an infraction of the published rules and regulations, a suspension may not exceed **30 days**. Where the underlying issue has not been resolved, the Association's practice is to renew the suspension in successive periods until it is. Note the contrast: a suspension for unpaid assessments has no 30-day limit — it runs for as long as the money is owed.
